外國專家換單位、崗位新辦工作許可證辦事指南

● 申請人基本條件

1、應年滿18周歲🍑，身體健康𓀃🧨，無犯罪記錄，境內有確定的用人單位，具有從事其工作所必需的專業技能或相適應的知識水平📰。

2、所從事的工作符合我國經濟社會發展需要，為國內急需緊缺的專業人員😗。

3、根據《外國人來華工作分類標準（試行）》確認外國人才類別：

4	外國人來華工作許可申請表	電子&原件	國際合作處專管員在線填寫信息後生成表格，申請人親筆簽字,加蓋國際合作處公章。
5	工作資歷證明	電子&原件	由申請人原工作過的單位出具從事與現聘用崗位工作相關的工作經歷證明🐈‍⬛，包括職位💴、工作時間或曾經做過的項目，需申請人原工作單位加蓋公章或負責人親筆簽字🤦🏼‍♀️，並留有證明聯系人有效聯系電話或電子郵件🏌🏿‍♀️。	外國高端人才（A類）（一）入選國內人才引進計劃的；（二）符合國際公認的專業成就認定標準的外國高端人才💆，該項采用承諾製🧙🏻‍♀️。其他類別的外國人才仍需提供工作資歷證明。如申請人在專業領域知名獎項獲獎，可提供相應獲獎證明材料。
6	最高學位（學歷）證書	電子&原件	最高學位（學歷）證書在國外獲得的🐧，應經我駐外使、領館或由申請人獲得學位（學歷）所在國駐華使👩🏿‍🚀、領館或我國學歷認證機構認證🧘🏼；在港澳特別行政區和臺灣地區獲得的👱‍♂️🧛，應經我國學歷認證機構認證或經所在地區公證機構公證🫅🏻；在中國境內獲得的，僅提供學歷（學位）證書原件🤽。	符合《外國人來華工作分類標準》外國高端人才（A類）（一）入選國內人才引進計劃的；（二）符合國際公認的專業成就認定標準的；（三）符合市場導向的鼓勵類崗位需求的外國人才👩🏻‍🚀；（四）創新創業人才的🧘🏻👩‍🦼，該項采用承諾製。其他類別的外國人才仍需提供最高學位（學歷）證書及認證材料🏵。
7	國籍國或長期居住國（地區）官方出具的無犯罪記錄證明	電子&原件	由申請人國籍國或經常居住地警察、安全🪝✍️、法院、公證機關等部門以及國籍國駐華使🙅🏽🧖🏼、領館或我駐外使、領館出具。經常居住地指申請人離開國籍國最後連續居住一年以上的國家或地區，不包括中國境內；在港澳特別行政區和臺灣地區出具的無犯罪記錄證明，應經所在地區公證機關公證🔽。	無犯罪記錄簽發時間應在6個月內。不接收僅為本人聲明無犯罪的宣誓性無犯罪記錄。外交（含外國駐華使、領館）出具的非宣誓性無犯罪記錄可直接接收，不再認證。外國高端人才（A類）無需提供；外國專業人才（B類）需提供。工作類居留許可在有效期內，或外國人未出境且工作類居留許可註銷不滿一個月，可以免提供無犯罪記錄證明🔃。
8	體檢證明	電子&原件	由中國檢驗檢疫機構出具的體檢證明，簽發時間在6個月內。	體檢地點：上海市金浜路15號，需至少提前二周網上預約；體檢結果取2份原件💂🏽‍♂️🧗🏻‍♂️，一份用於申辦工作許可，一份用於申辦居留許可。外國高端人才（A類）及持有有效居留許可的外國專業人才（B類）可免提供體檢證明🦻🏻。
9	聘用合同	電子&原件	應提供中文合同👨‍👩‍👧‍👧，須由申請人簽名並加蓋單位公章，不能塗改。	合同應當包括工作地點、內容🥊、薪酬、時間®️、職位、蓋章簽名頁。
10	翻譯材料	電子	上述所有外文材料（護照除外）☘️，均需提供對應的中文翻譯(包括印章信息的翻譯)👨‍🦯‍➡️⚰️，並加蓋國際合作處公章。
11	護照	原件	護照有效期不得少於6個月。
12	註銷單	電子&原件		屬於在華工作的外國人變換用人單位或崗位的，應先行註銷現有工作許可。
13	其他	電子&原件	發證機關認為需要的其他證明材料。

註😹：

1🧑🏻‍✈️🌀、已在外國人來華工作管理服務系統申請辦理過《外國人工作許可證》，且已上傳過最高學位（學歷）證書和工作資歷證明材料的申請人🧵，再次申請時，可不提交最高學位（學歷）證書。申請崗位與原工作許可批準聘用崗位相同的🪩，可不提交工作資歷證明材料；申請崗位（職業）與原工作許可批準聘用崗位（職業）不同的💂🏻‍♂️，應提供工作資歷證明。用人單位未變更但崗位變更新辦證時，可免提供最高學位（學歷）證書的認證材料。

2、不符合直接辦理《外國人工作許可證》情形的👊🏽↗️，但已入境的申請人，須按新辦《外國人工作許可通知》程序辦理💂‍♂️。

3↔️、符合《外國人來華工作分類標準》外國高端人才（A類）（一）入選國內人才引進計劃標準的申請人無需遞交紙質材料至我處；符合其他外國人才標準的申請人仍需提交所有上傳材料原件到我處🥞，外事專管員提交至辦證受理窗口核驗🧛‍♀️。

4☛、關於文書領事認證規定可查詢中國領事服務網（網址http://www.cs.mfa.gov.cn/），或具體聯系相應的中國駐外使、領館💁‍♀️🧔🏻‍♂️。

5、審批期限：10-15個工作日（以提交完整並符合要求的材料為準）。

A New Work Permit Due to Changes in the Employer or the Post

● Basic Requirements for Applicants

1. The applicant should reach the age of 18 in good health status and have no criminal record and a specific employer in China; the applicant should have knowledge or skill commensurate with the target post.

2. The corresponding post should satisfy the economic and social development of China and the candidate should be a professional talent much needed in China.

3. The category of foreign talents that the applicant falls into is decided according to “Evaluation Criteria for Foreigners Employed in China (Trial)” :

5	Work qualification certificate	Electronic&Original	Work qualification (related to the present post) certification issued by the former employer, covering the post, the term of the post and the projects done on the post. The certification should bear the official seal of the former employer or the signature by the person-in-charge and the valid telephone number or email account of the certifier.	Commitment system may apply in the following situations: satisfying the criteria for high-end foreign talents (Category A) ( 1) Selected for the domestic talent projects or (2) Satisfying the criteria for internationally recognized professional achievements. In other cases, a work qualification certificate is compulsory. In case the applicant has award (s) well known in the industry, the applicant may submit the corresponding certificates.
6	Highest degree (education background) certificate	Electronic&Original	The highest degree certificate obtained overseas should be certified by the overseas embassy or consulate of China or the embassy (or consulate) of the relevant country in China, or the education certification agency of China; the highest degree certificate obtained in Hong Kong, Macao and Taiwan should be certified by the education certification agency or notarized by the local notary public office. In case the applicant obtained the degree in China, the original certificate should be submitted without certification.	The commitment system applies in the cases where the applicant satisfies the criteria for high-end foreign talents (Category A) (1) Selected for the talent projects in China; (2) Satisfying the criteria for internationally recognized achievement; (3) Meeting the demand of the government-encouraged posts; (4) Innovative and entrepreneurial talents. In other cases, highest degree (education background) certificate is compulsory.
7	Certificate of no criminal record	Electronic&Original	The certificate should be issued by the police, the security department, or the court of the nationality state or the place of habitual residence and accredited by the overseas embassy or consulate of China or the foreign embassy or consulate in China. The certificate of no criminal record issued in Hong Kong, Macao and Taiwan should be notarized by the local notary public office. The place of habitual residence refers to the place (not on the territory of China) where the applicant lives most recently for at least one consecutive year after the applicant left his/her native country.	The certificate of no criminal record should be issued within 6 months. A personal oath of no criminal record shall not be accepted. Non-oath certificate of criminal record issued to diplomatic agencies (including the foreign embassy and consulate in China) may be directly accepted without accreditation. The commitment system applies to high-end foreign talents (Category A). In other cases, a certificate of no criminal record is compulsory. Cases where certificate of no criminal record can be omitted: the applicant holds a valid work class residence permit, or the applicant doesn’t leave Chin and his/her work class residence permit has been canceled less than 1 month.
8	Certificate of health examination	Electronic&Original	Issued by China’s inspection quarantine authoriy within 6 months.	Location: No. 15, Jinbang Road, Shanghai. Please make online reservation 2 week in advance. Keep 2 copies of the examination result, one for work permit application and one for residence permit application. Case where certificate of health examination can be omitted: high-end foreign talents (Category A), and professional talents (Category B) holding valid residence permit.
9	Employment contract	Electronic&Original	A contract in Chinese signed by the applicant and affixed with the official seal of the employer. No alteration is permitted.	The employment contract shall include the workplace, the contents of the work, the remuneration, the work period in China, the post, the page of seal (or signature) and other essential points.
10	Translation of all non-Chinese documents	Electronic	Chinese translation is required for non-Chinese documents (except for passports) and shall be stamped with the official seal of ICO.
11	Passport	Original	Passport with a validity term longer than 6 months
12	Cancellation certification of the current Work Permit	Electronic&Original		The applicant who changes the employer or the post should first cancel the current Work Permit.
13	Other documents	Electronic&Original	Other documents required by the licensing authority.

Remarks:

1. If the applicant has applied for the “Work Permit for Foreigners” online and has uploaded the highest degree (education background) certificate and work qualification certificate, there is no need to submit again the degree (or education background) certificate for the new application and the work qualification certificate may also be omitted in case the post under the new application is the same as the one approved in the former work permit. If the post (vocation) under the application is not the same as the one approved in the former work permit, the applicant needs to provide work qualification certificate. If the applicant changes the post but not the employer, the highest degree (education background) certificate can be omitted.

2. Those who are not eligible for the “Work Permit for Foreigners” but have already entered China will be required to apply for the “Notice of Work Permit for Foreigners”.

3. The applicant of high-end talents (Category A) (1) Selected for the talent projects in China doesn’t need to submit the original certificates and documents. In other cases, submission of all original documents is compulsory for examination and verification.

4. Please refer to the “China Consular Service Network” (http://www.cs.mfa.gov.cn/) for the regulation concerning the accreditation of the documents, or contact the corresponding Chinese embassy or consulate.

5. Time required for examination and approval: 10-15 working days (after submitting qualified materials).
